Please read these Terms carefully. They form a binding agreement between you and Aurei. By creating an account or using the Services, you agree to them. If you do not agree, do not use the Services.
01Acceptance of these Terms
By downloading, accessing or using the Aurei mobile applications, the website at aurei.app and our related backend services (together, the “Services”), you accept these Terms and our Privacy Policy, which is incorporated by reference. If you use the Services on behalf of an organisation, you represent that you are authorised to bind it.
02Who we are
03Eligibility
You must be at least 18 years old and legally able to enter into this agreement to use the Services. Do not register an account on behalf of a minor.
04Your account
- You may register with an email address and password, or with Sign in with Apple or Sign in with Google.
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your credentials secure and for all activity under your account. Given what an Aurei vault contains, we strongly recommend enabling two-factor authentication and using a unique password.
- Choose a username that is not misleading, offensive, or impersonating another person. We may rename or suspend accounts that breach this.
- Notify us promptly at support@aurei.app of any unauthorised use.
- You may delete your account at any time from within the app.
05Licence to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial collection management — or, where you hold a partner or professional account, for the purpose we agree with you in writing. We reserve all rights not expressly granted. You may not copy, modify, reverse engineer, resell or create derivative works of the Services except where permitted by law.
06What Aurei is — and is not
We help you catalogue what you own, document its provenance, follow its estimated value, and — if you choose — show it to others and receive offers. We are not a party to any sale, we do not hold your items, we do not hold funds, and we do not give financial, investment, tax, legal or insurance advice.
07Valuations & market data
- Values shown in Aurei are either values you assign or estimates derived from third-party market data for comparable items.
- They are indicative only. They are not guarantees of resale value, appraisals, insurance valuations or financial advice, and must not be relied upon as such.
- Market data may be inaccurate, delayed, incomplete or unavailable, and market values are generally expressed in a source currency that is converted for display using daily exchange rates. Converted figures are approximations.
- Portfolio analytics, performance figures and returns are arithmetic on the numbers you and the market sources provide. They inherit any error in those inputs.
- For insurance, tax, probate or sale purposes, obtain an independent professional appraisal.
08Your records & provenance
You are responsible for the accuracy of what you record — descriptions, serial and reference numbers, documents, purchase and sale figures, and transfer history. A passport, certificate or provenance record generated by Aurei reflects what has been entered and, where applicable, what a partner has validated. It is a record, not a warranty of authenticity, ownership or condition by us. Do not present an Aurei document as an independent certificate of authenticity.
Aurei is not a substitute for your own backups of critical documents. We take reasonable care to keep your data safe (see the Privacy Policy) but you should retain your own copies of irreplaceable paperwork.
09Trust levels, verification & badges
Trust levels, verification status, integrity scores, badges and leaderboard positions are internal signals calculated from the documentation, validations and transfer history attached to an item or an account. They are indicators of how well something is documented, not a guarantee that it is genuine, lawfully owned or accurately described. We may recalculate, withhold or remove any such signal, including where we suspect inaccuracy or abuse. Identity verification is optional and, where offered, is performed by a third-party provider; a verified badge means that provider returned a positive result, nothing more.
10Partners & specialists
Aurei can put you in touch with independent partners — authenticators, dealers, appraisers and specialists — and can arrange a specialist visit. Unless we state otherwise in writing, partners are independent third parties, not our employees or agents. Their opinions, verdicts, appraisals, fees, conduct and any contract you enter into with them are their own responsibility. We facilitate the request and record the outcome; we do not warrant a partner's verdict and we are not liable for it. When you submit an asset for validation you consent to the asset's details, photos and attached documents being shared with the chosen partner for that purpose.
11Offers, transfers & dealings between users
- Offers, messages, transfers and any resulting sale happen directly between users. Aurei records and facilitates; it is never the buyer, the seller, the escrow agent or the payment processor.
- You are solely responsible for verifying your counterparty, agreeing terms, arranging payment, delivery, insurance, export/import, customs and any tax due.
- An offer or a recorded transfer inside Aurei does not by itself transfer legal title to anything. Title passes according to the law and the contract between you and the other party.
- Do not treat an in-app record as proof that payment has been made or that goods have been received.
- We may withhold, block or reverse offer and transfer functionality on an item flagged as lost, stolen, disputed or suspected counterfeit.
- Exercise the same caution you would in any private high-value transaction. We cannot recover your money or your item if a deal goes wrong.
12Lawful ownership & prohibited items
By recording an item you represent that you own it or are otherwise entitled to record it, and that holding and (where relevant) selling it is lawful for you. You must not use Aurei to catalogue, advertise, offer or transfer:
- stolen, looted or unlawfully exported property, or items subject to a restitution claim you have concealed;
- counterfeit goods or items you know to be misdescribed;
- items whose trade is restricted or prohibited where you are — including protected wildlife products, certain firearms and cultural property without the required permits;
- anything in breach of sanctions, export-control, anti-money-laundering or tax law.
We may suspend accounts, remove records, check items against stolen-property registers, and report activity to registers or authorities where we have a reasonable suspicion of any of the above. If you discover that an item you hold is reported stolen, you must not use Aurei to conceal or move it.
13AI Advisor
The Advisor generates answers using a third-party AI service. Its output may be incomplete, out of date or wrong, and it is informational only — not financial, investment, tax, legal, insurance or appraisal advice. Verify anything material before acting on it, and do not send the Advisor information you are not comfortable having processed by our AI provider. Do not use the Advisor to attempt to value an item for a formal purpose.
14Acceptable use
You agree not to:
- use the Services unlawfully or in breach of these Terms;
- upload content that infringes intellectual property, is harassing, hateful, defamatory, misleading, or depicts illegal goods;
- upload photographs of other people, or of other people's property, without the right to do so;
- impersonate anyone or misrepresent your affiliation, expertise or the provenance of an item;
- attempt unauthorised access, probe or disrupt the Services, or circumvent security, rate limits or entitlement gates;
- scrape, data-mine, or use automated means to collect other users' data or our catalog and valuation data;
- use the Services to harvest information about other collectors' holdings, or to target anyone for theft or fraud.
15Your content
You retain ownership of everything you submit — asset records, photos, documents, comments and messages (“User Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and transmit your User Content solely to operate and provide the Services to you, including to the audiences and partners you direct it to. We do not sell your User Content and we do not use your photos for marketing without asking you first. You are responsible for your User Content and confirm you have the rights to share it. We may remove content that breaches these Terms and may suspend commenting for accounts that accumulate upheld reports.
16Subscriptions & payments
Aurei has a free tier and paid tiers (currently Collector and Elite) which unlock features such as an unlimited number of assets, offers and marketplace visibility, advisor access and partner validations. Purchases are processed by the Apple App Store or Google Play and are subject to those stores' terms. Unless stated otherwise:
- subscriptions renew automatically until cancelled;
- you manage and cancel a subscription in your App Store or Google Play account settings — cancelling stops future renewals and does not refund the current period;
- prices and applicable taxes are shown before purchase and may change with notice;
- refunds are handled by the relevant app store under its own policies;
- your entitlement is determined by the store's record of your purchase, not by anything the app claims locally;
- if a subscription lapses, features above your tier become read-only or unavailable, but your data is not deleted — it remains and becomes fully usable again if you resubscribe.
17Right of withdrawal (EU consumers)
If you are a consumer in the EU you normally have 14 days to withdraw from a purchase of digital content. By starting to use paid digital content immediately you may expressly consent to supply beginning before the withdrawal period ends and acknowledge that you thereby lose the right of withdrawal, to the extent permitted by law. Statutory consumer rights remain unaffected.
18Third-party services & data
The Services rely on and display material from third parties, including sign-in providers (Apple, Google), cloud hosting and storage, push and analytics infrastructure, an AI provider, an identity-verification provider, stolen-property registers, exchange-rate data, and market-data and catalog sources for watches, cars, sneakers, wine and other categories. These are provided by their respective owners under their own terms; we do not control them and are not responsible for their availability, accuracy or security. Third-party content remains the property of its owners and is used in accordance with the applicable licence or agreement. Attributions for open-source components are listed in the app under Settings → Legal → Open-source licenses.
19Intellectual property
The Services — including the Aurei name, logo, design, software, catalog compilation and content, excluding User Content and third-party content — are owned by Aurei and protected by intellectual property law. Nothing in these Terms transfers ownership to you.
20Availability & changes to the Services
We aim to keep the Services available but do not guarantee uninterrupted access. We may add, modify, suspend or discontinue features, including moving a feature between tiers, with reasonable notice where a change is material and to your disadvantage. We may also update these Terms; the revised version is posted with a new effective date and, for material changes, we notify you in the app. Continued use after changes take effect constitutes acceptance.
21Disclaimer of warranties
To the maximum extent permitted by law the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be error-free or uninterrupted, that valuations or market data will be accurate, that an item is authentic or lawfully owned, or that a counterparty will perform. Mandatory statutory warranties for consumers are not excluded.
22Limitation of liability
To the maximum extent permitted by applicable law:
- Aurei is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, profits, opportunity or goodwill.
- Aurei is not liable for losses arising from user-to-user dealings, a partner's or appraiser's opinion, reliance on an estimated value, theft or loss of a physical item, or the downtime or failure of a third-party service.
- Our total aggregate liability for any claim is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or EUR 100.
- Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud or intentional misconduct, for gross negligence, or under mandatory consumer-protection rules.
23Indemnification
To the extent permitted by law you agree to indemnify and hold Aurei harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, your dealings with other users or partners, or your misuse of the Services.
24Termination
You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access if you materially breach these Terms or where required by law, with notice where reasonably possible, and immediately where continued access would risk harm to others — for example a suspected stolen-goods or fraud case. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) survive.
25Governing law
These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer you also enjoy the protection of mandatory provisions of the law of your country of residence.
26Dispute resolution
We would rather resolve any issue informally first — please contact support@aurei.app. Subject to mandatory consumer rules, the courts of Vienna, Austria shall have jurisdiction. The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
27General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.
- Severability. If any provision is held invalid, the remainder stays in effect.
- No waiver. Our failure to enforce a right is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
- Language. These Terms are drafted in English. A translation is provided for convenience only; the English version prevails.
